Like dilluzionz has mentioned, if it is registered with your hosting company, you will need to check their terms and conditions in regards to domain registration and ownership..usually all the registrars can hold the domains for 60 days after they are registered..see your hosting companies terms of use..but if it is registered with some other domain registrar, your hosting company can not hold the domain whatever the reason may be as per the domain registrar policies..you are the legal owner of domain and can even report your hosting company for showing ownership to it..they usually can not hold the domains. Just change the name servers to any other account, and your hosting provider will no longer be affiliated with that domain..
